    Lowells seem to be ok with signed for post, but if you're concerned you can send it !st class post. (Get a free certificate of posting for proof).

    Could you please tell us what the Particulars of Claim say, word for word. (Remove/obscure any personal details, but don't damage the actual court claim form if you post a picture).

      Hi iv posted a SARS to shop direct and also Lowells requesting all the documents agreement statement etc recorded delivery this morning as on my credit file on one site there is 1 default on another site there are 3 different ones for same debt all different months surely these should all match from one credit ref agency to another and should only be one default on the debt please advise as confused thanks

          Hi they are black with white D on it nothing in red at all and it's showing as I said a default march 2012 on one ref agency and then may 2012 on a another as well as abt 3 other different dates all the same with a white D

            Ok this is the monthly update showing the status of the account not a new default, it just shows that the default still exists.

                  Hi ok as I said in a earlier thread iv received a direction questionnaire from lowells filled in with no signature attached to it that bit is missing saying they have lodged this to the court I haven't had one from the court either that was 8 days ago I received that . On reading abt the direction questionnaire it's suppose to be the court sending this out not the claimant I think it's just tactics to scare me there was a letter with it saying to call them if I needed to discuss further advise please

                      I sent off requesting all the documents regarding a debt with shop direct one to lowells and one to shop direct got promised by email they would be sent by lowells but nothing enclosed the fee etc . Phoned lowells today asking why had these documents not been sent as it's my right to be told they not obliged to have to send them am I right if they don't send me my request they cannot go further in court I have no evidence of this debt to hand except what they are saying .... by the way this debt is 7 years old too no payment made since 2009 and no acknowledgment to it either thanks everyone

                        Is this about your main thread.
                        What did you send to Lowell a formal SAR + £10 fee.
                        And the same to SD? have they responded?
                        A SAR is for any and all personal data an organisation hold on you nothing else.

                          Hi nem yes to my main thread it was a cca request to lowells and shop direct enclosed £1 postal order I have phoned lowells requesting all the documents they said they don't have too they can just present them in court . I told them it's my right they supply me proof of this debt as it's 7 years old with no payment since 2009 and no acknowledgment either thanks

                            Looks like you have been confused by the mass of information thrown at you lately. So I'll explain.

                            A Subject Access Request is made under the provisions of the Data Protection Act 1998 and has a statutory fee of £10.00 and a 40 day timescale.

                            It requires the recipient to supply all " personal data it holds on you.

                            A CCA request is made under the provisions of the Consumer Credit Act 1974 (as amended) there is a £1.00 statutory fee for this and a 12 + 2 Working Days timescale for compliance.
                            The CCA request is specifically for 1. A copy of the regulated credit agreement and 2. A certified current statement of the account, nothing else.

                            In your case the CCA request to Lowell + £1.00 fee. ( No point in a SAR to Lowell they hold only minimal date supplied when the acquired the debt a waste of 10 quid)
                            Without the agreement the debt is unenforceable until Lowell can provide it or a compliant reconstituted one.

                            The reason for the SAR is to get you information and documents so you can check them against any thing Lowlife comes up with.

                            I hope this make it clearer for you.
